Please read these terms carefully before using the GitSniff platform.

1. Acceptance of Terms

By accessing or using GitSniff ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. AI Code Review Services

GitSniff utilizes artificial intelligence and static analysis tools to review code. You acknowledge that:

  • AI Limitations: AI models may produce "hallucinations" or incorrect suggestions. Code reviews should always be verified by a human developer.
  • No Warranty: We do not guarantee that the Service will find all bugs, vulnerabilities, or errors in your code.
  • Execution: You are solely responsible for the code you merge or deploy based on our suggestions.

3. Usage-Based Billing

GitSniff operates on a consumption-based pricing model. You are charged based on the number of tokens processed (input code + output analysis).

  • Billing Cycle: Charges are calculated daily and billed at the end of your billing cycle or when a threshold is reached.
  • Refunds: Due to the nature of API consumption, we generally do not offer refunds for resources already consumed, unless there was a platform error.
  • Spend Limits: Users are responsible for configuring spend limits in their dashboard to prevent overage charges.

4. Intellectual Property

Your Code: You retain full ownership of all source code submitted to the Service. We claim no intellectual property rights over the material you provide to the Service.

Our Processing: You grant GitSniff a limited, non-exclusive license to process your code solely for the purpose of generating the review. As stated in our Privacy Manifesto, we do not retain your code after processing, nor do we train our models on it.

5. Limitation of Liability

IN NO EVENT SHALL ANNITACODE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

7. User Conduct and Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Transmit any malware, viruses, or malicious code through the Service.
  • Attempt to gain unauthorized access to our systems, other user accounts, or computer systems or networks.
  • Reverse engineer, decompile, or disassemble any aspect of the Service.
  • Use the Service to conduct security testing or penetration testing without our prior written consent.
  • Resell, sublicense, or redistribute the Service without our explicit permission.
  • Use automated systems (bots, scrapers) to access the Service in a manner that sends more request messages than a human could reasonably produce.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.

8. Account Termination

Termination by You

You may terminate your account at any time by contacting us at support@gitsniff.ai or through your account settings. Upon termination, we will delete your account data in accordance with our Privacy Policy.

Termination by Us

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful to the Service or other users. We will provide you with reasonable notice before termination, except in cases of severe violations, fraud, or illegal activity.

Effect of Termination

Upon termination, your right to use the Service will immediately cease. We will retain your data as described in our Privacy Policy, including for billing purposes and as required by law. Any charges incurred before termination remain your responsibility.

9. Dispute Resolution and Arbitration

Informal Resolution

Before filing a claim, you agree to contact us at legal@gitsniff.ai to attempt to resolve the dispute informally. We will make good faith efforts to resolve the dispute within 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) Commercial Arbitration Rules. The arbitration will be conducted in Delaware, United States, or remotely via video conference.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and GitSniff individually. You waive the right to participate in a class action, class arbitration, or other representative proceeding.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

If you do not agree to the modified Terms, you must stop using the Service and terminate your account.

11. Indemnification

You agree to indemnify, defend, and hold harmless GitSniff, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of the Service;
  • Your violation of these Terms;
  • Your violation of any third-party rights, including intellectual property;
  • Any code you submit, merge, or deploy based on our suggestions.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
